Bridgeport Township, Crossing Rivers to negotiate remediation of water issues

Bridgeport Township has decided to work with Crossing Rivers Health—and avoid a lawsuit­—in the case of the medical center’s claim that a 2016 town road project caused diversion and trespassing of flood waters to the hospital campus’ property. 

The town board met Oct. 16, and motioned to authorize its legal counsel to negotiate with Crossing Rivers and others in an attempt to reach a global resolution to the problem that was created. The action followed over an hour of closed session discussion.

“It’s what everyone would like to see,” Town Clerk Linda Smrcina said, after the meeting.

Bridgeport’s attorney is Nicole Bacher, of Cross Jenks Mercer & Maffei, in Baraboo.

This step toward resolution last week comes five months after Crossing Rivers and its legal counsel filed a notice of claim contending “unreasonable diversion of surface waters causing flooding, water trespass and damages to its property” as a result of “negligent planning, designing, engineering, construction, supervision and inspection” of an expansive Town Road Improvement Project (TRIP) for the reconstruction of Vineyard Road in summer of 2016.

Crossing Rivers’ attorney is Sara MacCarthy, from Hall, Render, Killian, Heath & Lyman, of Milwaukee.

“We’re committed to the county, the township and surrounding communities to request collaborative assistance to remediate the issues as filed in the notice,” MacCarthy said in public comment prior to the town board’s closed session. “Otherwise, it would likely prevent our property from being usable for our campus plan.”

“Water has gone [onto the hospital’s] property in the past. We don’t dispute that,” added Kevin Kimmes, engineer and senior associate with Stantec, of Milwaukee. “We’re saying the conveyance of water to our property is three residential swimming pools per second. It’s changed dramatically.”

He shared that Crossing Rivers doesn’t simply want to pass the buck elsewhere. MacCarthy agreed, noting her party wants to be the “preeminent neighbor.”

“We’re happy we have this opportunity to come to a global resolution and have this fixed,” MacCarthy added, stating that engineers will likely be brought in and neighbors input should be considered as well moving forward.
